ATTENTION AOCE MEMBERS! PLEASE READ THIS – STATE COUNTER PROPOSAL ON VACCINE MANDATE ATTACHED!
Attached is DAS’s ridiculous, laughable counter proposal to our vaccine mandate proposal. Please pay special attention to Sections 7 and 8!
DAS said there would be no personnel action taken if a staff member started the exception process by October 18th. However, in this counter, they say you will have to use your own vacation or compensation leave, or leave without pay, after October 18th until you get an answer on your exception and/or get vaccinated. Those staff must be vaccinated by November 30th, using vacation/comp time/or LWOP until then! NO SICK TIME USAGE WILL BE ALLOWED from 10/18/21 through 11/30/21 in their proposal! Their counter proposal says you will not be terminated before November 30, 2021, if you have started the exception or vaccine process, but you will only have 7 days to get your first shot if your exception is denied after October 18th.
PLEASE NOTE, DAS is saying if an exception is approved the reasonable accommodation may include remote work, transfer of job (which may not be equal pay), shift changes or physical modifications.
We are actively fighting this forced vaccination as a condition of employment. Our Temporary Restraining Order (TRO) was filed in court today and our State lawsuit was filed last week. Our attorneys have a status conference call with the court tomorrow and we’re hopeful we’ll have a hearing date set.
